Non-Compete Agreements

Non-compete agreements are generally an agreement between an employer and an employee stating that, if the employee decides to leave the company, he or she will not work for a competitor for a specified period of time. Often non-compete agreements are presented as a condition of employment.

The enforceability of non-compete agreements varies from state to state, with some states declaring all such agreements invalid. In Illinois, courts have looked on non-compete agreements with skepticism, generally finding that they are enforceable if the terms of the agreement are reasonable, and if the agreement is necessary to protect an employer’s legitimate business interest.
